The employees who were injured in slip and fall accidents were able to resolve their claims in only slightly less time than those with all other types of injuries. Of the employees who received a financial settlement for a slip and fall accident, 38 percent of those employees had their claims initially denied. Pre-existing conditions are responsible for close to half of all denied claims for slip and fall injuries. Insurance companies often look for ways to avoid granting a claim, often blaming the injury on a pre-existing injury, or the effects of aging if an older employee was injured.

For employees whose claim was initially denied, 45 percent of employees with slip and fall injuries had to take additional steps to obtain benefits, including filing an appeal or requesting a hearing in order to receive a settlement.

Close to 70 percent of workers surveyed hired a Workers’ Compensation lawyer to help them with their case. According to the survey of the employees who received a settlement, those who hired a lawyer received between $18,900 and $29,600. Employees who did not hire a lawyer received between $13,000 and $22,000.
