Baltimore Workers’ Compensation Lawyers: Slip and Fall Workplace Accidents

Posted on

Slip and fall accidents are one of the most common types of accidents that occur in the workplace. A simple slip, trip, or fall on a slick, wet, or uneven surface can put a worker out of commission. While Workers’ Compensation is meant to cover medical expenses for injured employees, it is not always enough, and applying for it can be a time-consuming process. Baltimore Workers’ Compensation lawyers report that, according to a recent survey from Martindale-Nolo, the average compensation workers received was between $17,200 and $27,500, and it took an average of 14.9 months to resolve the claims.

While the majority of the workers surveyed received some financial compensation for their injuries, almost half of those surveyed only received $10,000 or less. The employees who were injured in slip and fall accidents were able to resolve their claims in only slightly less time than those with all other types of injuries. There are several factors that influence how long it will take for a claim to be processed, including the following:

  • The insurance company initially denies your claim
Of the employees who received a financial settlement for a slip and fall accident, 38 percent of those employees had their claims initially denied. Pre-existing conditions are responsible for close to half of all denied claims for slip and fall injuries. Insurance companies often look for ways to avoid granting a claim, often blaming the injury on a pre-existing injury, or the effects of aging if an older employee was injured.
  • It is necessary to file an appeal or request a hearing to resolve your claim
For employees whose claim was initially denied, 45 percent of employees with slip and fall injuries had to take additional steps to obtain benefits, including filing an appeal or requesting a hearing in order to receive a settlement.
  • The Counsel of a skilled Workers’ Compensation lawyer
Close to 70 percent of workers surveyed hired a Workers’ Compensation lawyer to help them with their case. Considering how often claims are initially denied, it is in the employee’s best interest to have an experienced lawyer on his or her side to help navigate the complex claims process. According to the survey of the employees who received a settlement, those who hired a lawyer received between $18,900 and $29,600. Employees who did not hire a lawyer received between $13,000 and $22,000.
